All coordinates, waypoints, maps, and data provided by FishOn, LLC (hereafter referred to as "the Company," "we," "us," or "our") are sold strictly as informational data for recreational fishing purposes only.

Our data is NOT intended for navigation. Under no circumstances should these coordinates or digital files be used as a primary or secondary navigation tool. GPS data can become outdated, inaccurate, or misaligned on various third-party marine GPS units, mobile apps, or mapping software.

2. ASSUMPTION OF RISK & ON-THE-WATER HAZARDS

Navigating bodies of water (oceans, lakes, rivers, and streams) is inherently dangerous. Environmental conditions are constantly changing. By purchasing and using our digital data, you (the "Customer," "user") explicitly acknowledge and agree that:

• Water depths, sandbars, reefs, tides, currents, weather patterns, and underwater hazards change dynamically. A coordinate that was safe yesterday may be hazardous today.

• Some fishing spots may be located in shallow water, restricted areas, or zones with submerged obstructions (wrecks, logs, rock piles) that are not visibly apparent.

• It is the sole responsibility of the vessel's captain/operator to maintain a proper lookout, evaluate local water conditions, utilize official NOAA/governmental navigational charts, and exercise safe boating practices.

3. ABSOLUTE LIMITATION OF LIABILITY & INDEMNIFICATION

To the maximum extent permitted by applicable law, FishOn, LLC, its owners, employees, and affiliates shall not be held legally or financially liable for any incidents that occur on or off the water.

By purchasing our products, you agree to indemnify, defend, and hold harmless the Company from any and all claims, damages, losses, liabilities, or expenses (including legal fees) arising out of or related to:

• Property Damage: Including, but not limited to, damage to your boat, motor, propeller, hull, fishing gear, or GPS equipment.

• Personal Injury or Death: Any bodily injury, illness, or death occurring to you, your passengers, or third parties while traveling to, from, or fishing at any coordinates provided by us.

• Legal Violations: Any fines or penalties incurred for entering restricted waters, marine sanctuaries, private property, or military zones.

4. NO GUARANTEE OF RESULTS ("NO-FISH" DISCLAIMER)

While our coordinates highlight historical or calculated fishing structures, we make absolutely no guarantees, explicit or implied, that you will catch fish at these locations. Fish move based on season, temperature, and bait availability.

5. NO WARRANTIES

All digital products are provided on an "as-is" and "as-available" basis without any warranties of any kind, either express or implied. We do not warrant that the digital files will be error-free or compatible with every brand of marine electronics.
